Cross-examination (transcript of October 7, 2021)

  1. The general conduct between Reuven and the defendant was that the defendant used to convey to Reuven an initial demand, the witness gave him a price quote in response, and later additional demands and upgrades arose that led to an upgrade or increase in the price of his offer (p. 379). Reuven confirmed that he himself prepared work estimates that were routinely forwarded to the defendant and the IPS (p. 380).
  2. His first proposal for the ramp project in Hadarim Prison was NIS 10,000-12,000. Later, following a tour of the area, the proposal became more expensive in terms of raw materials, increasing the area of the ramp, stairs and more. The witness worked on the project for about a week, together with another worker (pp. 379, 382). When asked how many tons of galvanized he used for the project, he replied that he did not remember and that in the said project he did not calculate by weight (p. 383). Perhaps 2-3 tons, with the cost of a ton as of the time of testimony being about NIS 17,000, but as of the time of execution its price was about NIS 3,000-4,000 (pp. 384, 386-387). To the question of why he submitted an invoice for approximately NIS 49,000, he replied that he issued an invoice that was larger than the amount he was supposed to receive, and transferred the difference to the defendant (p. 388). He gave the defendant a general price, and not according to sections, because that is what the defendant asked him to do (p. 389). When asked to explain what his profit from pricing of NIS 26,000 was, he replied that at that time the cost of a ton was about NIS 3,000 or NIS 3,500, so that the cost of the materials was NIS 7,000. He arrives at the final price by calculating the cost of materials as one-third, and two-thirds as labor costs (p. 390). In the same project, the cost of materials was about NIS 7,000 and the cost of a crane was about NIS 2,000, and the cost of antitrust was about NIS 9,000. The tripling of this sum amounts to approximately NIS 27,000 (p. 390).
