Testimony of Moti Zehavi (transcript of September 20, 2022)
Main Inquiry
- The witness is an investigator in the Income Tax Diamond Unit, an investigator appointed as the Chief Inspector since May 2010 – the principal investigator who led the case. As part of his testimony, many exhibits relating to indictment 15 were submitted.
- As part of the investigation, income was investigated, including renting the apartment in Hadera, renting the various units in the motel, bribery in money, bribes equivalent to money (work performed for the defendant by contractors). The investigator cannot know the source of income in cash, whether in bribes given in cash, bribes in checks that were paid at the exchange and subsequently deposited, or in cash rent payments (p. 331).

The logical database of the defendant and the defendant from the Tax Authority (P/130);
Reports on the defendants' income for the years 2014, 2015 and 2016 (P/131, P/132 and P/133, respectively). Exhibits P/131 to P/133 do not report rental income.
Reports of N.K. Building (owned by the defendant) for the years 2014, 2015 and 2016 (P/134, P/135 and P/136, respectively).
In Exhibit P/135 (2015 report), in the annotations section of the report, it was noted that in 2014 the company began renting a property to tourists, and that in the same year (2014) the company's income from renting this property was NIS 8,220.
In Exhibit P/136 (2016 report) it was noted that in 2015 the company's income from renting this property was NIS 4,340 and in 2016 there was no income from renting the property (p. 329).
The investigator did not have before him reports for the years 2017 and 2018 (p. 329).
- Wiretapping transcripts of conversations relating to the rental of apartments in the motel were submitted. In order to avoid repetition, the conversations will be detailed in the context of the defendants' testimonies.
Exhibit A/139 was also submitted - WhatsApp correspondence in Russian between the defendants, in which you can see prices of ₪80, ₪100, and ₪130 per night, plus NIS 150 cleaning fees.
- Wiretapping transcripts were submitted regarding the defendant's conduct after the defendant's arrest. The conversations will be detailed in the context of the defendant's testimony.
