Expert Testimony - Motion Tester
The testimony of examiner Maayan Sabari is the testimony of an expert witness.
As part of his testimony in the examiner's main interrogation, all the documents he had prepared and signed were submitted..
The examiner described in the examiner's report (P/29) the environmental conditions in which the accident occurred (exit from the curve, dark road, wet road, poor visibility), the field of vision that was available to those involved and the eyewitness, data and measurements made by the examiner, adjustment of damages and the position of the vehicles after the collision, with reference to other findings on the road, which were documented in the diagram and sketch (P/31, P/37).
The examiner also submitted color photographs he took from the scene and video footage he took at the scene and in a field of vision experiment.
The examiner also questioned those involved in the accident, the driver of the vehicle involved, a passenger in her car, eyewitnesses and the defendant.
As part of the accident investigation, the examiner even acted to obtain a wheel expert's opinion, although there is no dispute that this is not a wheel failure in this accident and it was not claimed by the defense of a wheel failure.
The examiner also addressed in an examination report the matter of removing the airbag computer from the vehicles involved, as I will discuss later in a separate chapter.
The examiner testified about these things in the course of his main interrogation.
The examiner's cross-examination, was mostly concerned with exposing deficiencies in the examiner's work when he collected the evidence, the examination of the witnesses, and the verbal description of the contents of the examiner's report.
The defense cross-examined this witness for a long time and focused the interrogation on the witness's knowledge of the manner in which all the examinations relating to the documentation of the scene were carried out, to his determinations regarding the field of vision test, regarding the location of the grooves, regarding his reliance on eyewitnesses, regarding his determination of who deviated from the driving lane and who was at fault for causing an accident, regarding the manner in which the contents of the examiner's report were recorded, and regarding the failure to inspect the airbag computers of the vehicles involved.
