Prosecution Witness Cohen Guy, in his interrogation with the police (P/5), when asked whether he had spoken to any of those involved, he replied:
"Only with the driver of the black car, he was walking around the scene sleepwalking, and I told him to sit down until they came to evacuate him.") Lines 20-21).
His police interrogation was submitted in lieu of a main investigation.
It should be noted, that the witness was not cross-examined because his words contradicted the defendant's version that after the collision the next thing was that he woke up in the hospital, and therefore the witness Guy's version that he spoke with the defendant immediately and shortly after the accident still stands.
Moreover, the prosecution witness Karni Aloni, who is a police officer, also prepared an action report (P/6) which was submitted in lieu of a main investigation.
In the action report, Officer Karni wrote down the following:
"The accident before Amatzia Square, the Mazda car stopped in the middle of the road, its details are attached, the driver was alone, his name was Shai Yosef Hennel, he walked normally, I spoke with him, claiming that he was alone and that he was feeling fine for this moment... It should be noted that the driver of the Mazda was also evacuated in light condition..."
From the aforesaid, it appears that the defendant's version in his testimony in the main interrogation, because what he remembers after the accident was that he woke up in the hospital, it is very puzzling and it is not clear why the defendant did not say that after the accident he walked around the scene of the accident, while the testimonies of the prosecution's witnesses - Guy Cohen and Karni Aloni - in this matter clearly showed that after the accident the defendant was on his feet and they spoke with him.
It appears that in this matter as well, the defendant's version was found to be unreliable.
Conclusion, the defendant's testimony is full of inaccuracies and contradictions, and it remains alone as a single testimony without any support for any evidence that contradicts the plethora of evidence brought by the prosecution.
