The examiner testified, that the damage to the windshield of the vehicle involved was caused by its hood. When confronted with the fact that this was not recorded in the examiner's report, he testified:
"In the examination report, I note the main things that were damaged. I see that I wrote that the windshield was damaged. I added my addition only because of the hypothesis or claim that the defendant's vehicle overtook the vehicle involved in order to explain it to you." (See his testimony of February 6,2025, p. 88, paras. 20-22).
When the examiner is confronted with this, because things he testifies about were not recorded in the report or were not said by the witnesses, he testified that this is not true, except for the deviations of the witness Israel Zadok.
With regard to a tire opinion, the examiner testified that The "Gant" is not crushed and that he is interested in whether the tire has air or no air. And that he did not add the issue of the tire to the examiner's report since the expert determined that the tire was in good condition prior to the accident and that the accident was not caused by a tire failure.
The examiner testified again that he relies on the witness Ayalon Zadok. According to him:
"Q. Even though he describes the accident in a completely different way than you determined?
A. I know what he told me. After two and a half years, he may have completed a few things from memory. As for the accident, I said that this is what Ayalon Zadok thinks or sees.
I'm willing to showThe court and those present to see a car accident and concentrate, and I promise you that after I ask everyone here after the video, they will not know how to answer 3 out of 4 questions, because a person is driving on a dark, wet road, unfamiliar to him, notices the accident in front of him when the whole incident happens in a split second, he will understand the main points that he analyzes and draws the conclusions.
The examiner must take the main points that a witness sees in such a situationto match what he sees on the ground and then determine whether what the witness saw could be." (See his testimony of February 6,2025, p. 91, paras. 11-19).
