Withdrawal - a successor who has departed from his parent's inheritance

  1. As may be recalled, the Family Court ruled that after the mother's death, the respondent signed a document that was predicted to be notices of withdrawal from her estate in favor of the appellant. Subsequently, it was held that if the respondent did lawfully withdraw from the mother's estate in favor of the appellant, "perhaps" this would have an impact on the manner in which the parties would inherit the deceased's estate.  On the other hand, the District Court held that since the parties inherit the deceased by virtue of their status As a substitute their parents, there is no significance to the respondent's withdrawal from the mother's estate.  In the appeal before us, the appellant reiterates that given that the respondent has withdrawn from the mother's estate, he is not entitled to take her shoes and inherit the deceased in her place.

As I will explain below, I am of the opinion that justice is with the District Court.  I will clarify:

  1. Section 6(b) The Inheritance Law Determines Admittedly Because "one who has withdrawn from his share of the estate is considered to have departed as if he had not inherited in the first place." Indeed, as has long been determined, A person's withdrawal from a testator's estate cancels his status as an heir of that testator (see: Civil Appeal 532/74 Deklo v. MunitzIsrSC 29(1) 464,467 (1974); Further Discussion 43/74 Munich v. DekloIsrSC 30(1) 242,243-244 (1975); Civil Appeal 1393/92 Hevel v. KazczkovIsrSC 48(4) 353,359 (1994); Shilo, at pp. 80-81).

However, this does not determine that when a person leaves his share of the estate Ordered him, he will not be able to come in his shoesּ As a caliph, As mentioned In the section 14(A) of the law.  It should be emphasized: This section does not state that His successor of a man who comes in his shoes, but "Childs" of a person.  If so, it is not required that the successor be the heir of the Ordered him, in order to come in his shoes for the purpose of inheriting the testator's estate, according to Section 14 to the law (see: Ilanit Shabbat (Halfon) Withdrawal in the Inheritance Law 128-129 (2020) (hereinafter: Saturday); Estate Case (Family Rishon LeZion) 32878-11-09 Anonymous vs.  Anonymous [Nevo] (3.10.2010); See also the matter of substitutes of a beneficiary according to a will, according to Article 49 To the Inheritance Law: Saturday, at pp.  127-128; Estate Portfolio (Family Chai') 17293-03-12 A.Z. v.  G.R. [Nevo] (9.7.2014); Family Bag (Family File) 6905-04-20 Y.P. v.  Y.P. , verse 33 [Nevo] (October 5,2020)).  Hence, even if a son departed from his mother's inheritance, this has no bearing on the fact that the son is Substitute His mother's In his brother's estate, as opposed to being his mother's heir In her estate, she.
