In the decision of the Honorable Judge Ronen of March 24,2025, it was determined that since the defendant had announced that at this stage he did not intend to sell the apartment, insofar as he wished to promote the sale of the apartment before a judgment was rendered in the proceeding, he would be required to inform the plaintiff of this at least 14 days prior to the completion of the transaction. This was in order to enable the plaintiff to apply to the court with a new request for temporary relief within the said period of time, to the extent that it deems it appropriate to do so. If such a request is filed, it was determined that the court will examine it in accordance with all the concrete circumstances that will be in place at that time; including taking into account the relevant balance of convenience considerations at the time of the decision. It was further clarified that if an application is filed, the defendant will not enter into an agreement for the sale of the apartment until a new decision is made by the court. As to the chances of the lawsuit, it was determined that the court did not express its opinion, and that the matter would be examined by the District Court as part of the hearing of the claim on its merits.
On June 12,2025, the plaintiff submitted her evidence, including an affidavit of the main witness on her behalf; an affidavit on behalf of Adv. Racheli; an affidavit of the realtor Tal; and the opinion of the appraiser, Ms. Moran Lavie-Livneh.
On July 7,2025, the defendant submitted his evidence, including an affidavit of the main witness on his behalf; an affidavit on behalf of his wife, Mrs. Adi; an affidavit on behalf of Adv. Lihi; an affidavit of the realtor Sapir; and the affidavit of the mortgage consultant, Mr. Amir Herman.
Evidentiary hearings were held on April 26,2026 and May 6,2026.
As stated, at the end of the evidentiary hearing held on April 26,2026, the plaintiff announced that she did not insist on the declaratory remedy for enforcing the contract, but only on the monetary remedies to which she petitioned in the statement of claim.
