In these circumstances, insofar as for any reason the plaintiff had not succeeded in completing the sale of her apartment in Kiryat Bialik, it is difficult to assume that she would have claimed that the draft regarding the purchase of the defendant's apartment was perfected into a binding agreement. This is in view of the fact that the plaintiff's financial ability to complete the purchase of the defendant's apartment depended, in practice, on the consideration she was to receive from the sale of her apartment. This can also be learned from the conduct of Racheli, who sought to adjust the payment schedule in the transaction for the purchase of the defendant's apartment to the payments received from the sale of the plaintiff's apartment in Kiryat Bialik (Appendix 23 to the plaintiff's exhibits).
Moreover. As detailed above, the plaintiff first sought to ensure that the agreement for the sale of her apartment in Kiryat Bialik would be signed, so that she could know with certainty that she had the necessary financial resources to purchase the defendant's apartment. For this reason, the plaintiff waited until October 29,2024, the date on which the agreement was signed for the sale of her apartment. However, even thereafter, the plaintiff was required to obtain approval in principle from the bank to provide a loan for the purpose of purchasing the defendant's apartment. The approval in principle was received only on October 31,2024 (Appendix 34 to the plaintiff's exhibits) - the day on which the defendant announced that he was no longer interested in advancing the transaction. This sequence shows that the plaintiff did not act to obtain the approval in principle for the mortgage before the main source of financing for the purchase of the apartment was secured, but initially waited for the completion of the transaction for the sale of her apartment, and only after she knew the amount that would be available to her from this sale, did she act to obtain approval in principle for a loan that would complete the sources of financing she needed. From this it can be concluded that even from the plaintiff's own point of view, the final decision with respect to the transaction for the purchase of the defendant's apartment was formed, at the earliest, on October 31,2024, upon receipt of the approval in principle for the receipt of the mortgage.
