On October 1,2024, Sapir arrived at the home of the defendant and his wife, Adi, and stated that following negotiations he conducted with Tal, the plaintiff improved her offer and set it at ILS 2,030,000. This offer reflected a reduction of ILS 170,000 from the defendant's first demand, which was ILS 2,200,000.
In response, the defendant clarified to Sapir that he and his wife wished to give an answer until after the High Holidays, which ended that year on October 25,2024. This was in order to consult with a mortgage consultant and obtain approval in principle from the bank after they had found an alternative apartment and had sufficient information regarding the budget available to them (paragraph 10 of the defendant's summaries; paragraph 11 of Sapir's affidavit).
The Ottoman Settlement [Old Version] 1916
12-34-56-78 Chekhov v. State of Israel, P.D. 51 (2) A few days later, on October 6,2024, Sapir sent a message in the WhatsApp group, in which he wrote, among other things, "As we agreed, today we will begin to advance the transaction under the terms we have closed. I will speak to Lihi and give her the details (Lihi is Adv. Lihi Anconina, who represented the defendant in the negotiations for the sale of the apartment - my addendum). You will begin to deal with the mortgage issue. I mentioned to Tal today the issue of 'pressure' in terms of the fact that on your part you will be efficient and on the other hand the buyers will not exert pressure but will let things flow" (the notice was attached at page 28 to the exhibits file on behalf of the defendant).
As he undertook, so he acted. On the same day, on October 6,2024, Sapir transferred the details of the transaction to Attorney Lihi Anconina (hereinafter: "Lihi"), who, as aforesaid, represented the defendant in the apartment sale transaction. According to the defendant, Sapir assured him that "the provision of the initial details is a technical matter, which will facilitate the progress of the transaction, if any, in the future" (paragraph 12 of the defendant's summaries).
