עובדת הגישה לבית הדין תביעה לפיצויים וטענה, בין היתר, כי פוטרה ללא עריכת שימוע מקדים. בית המשפט קבע לעניין זכות השימוע כי זכות זו היא חלק מחובת המעביד לפעול בתום לב ובדרך מקובלת בעת פיטורי עובד. זכות זו נועדה לאפשר לעובד לתקן את דרכיו וליתן לו הזדמנות נוספת להשמיע את דבריו בטרם יקבל המעסיק החלטה בדבר פיטוריו האפשריים. עם זאת, בית המשפט קבע, בהתייחס לבחינה הצורנית של חובת השימוע, כי החשוב הוא שתכלית השימוע תתקיים ואין משמעות הדבר כי חייבים להתקיים "כללי טקס" צורניים. במקרה דנן, הוכח כי הועלתה בפני העובדת בעל-פה האפשרות כי תפוטר היה ולא תשנה את דרכיה. לכן, נקבע כי גם אם לא נערך הליך רשמי של שימוע לעובד, אולם נערכו עמו שיחות והייתה לו הזדמנות להשיב על הטענות ולשפר את תפקודו, הרי שאין מקום לטענה כי נפל פגם בפיטוריו ולא כל 'פגם' בשימוע בהכרח יש בו כדי להצדיק מתן פיצוי.
