בית הדין הגבוה לצדק דחה לפני כשבוע עתירה כנגד החלטת בית הדין הארצי לעבודה, אשר שינה הלכה קודמת משנת 2000. בג"צ אישר בכך את ההלכה, כי העסקת עובדים במשמרות לילה שלא בהתאם לסעיף 22(א) לחוק שעות עבודה ומנוחה מנוגדת לחוק. במובן זה, חוזה העבודה של העותרת המאפשר העסקה המנוגדת לחוק לוקה בפסול של אי חוקיות. לעובדים על פי חוזה כזה לא מתגבשת זכות מוקנית להעסקה בניגוד לחוק, ואין בכוחם לדרוש מהמעסיק כי ימשיך להעסיקם באופן מנוגד לחוק, או לחלופין, כי ישלם להם שכר על בסיס הנחה כי הם מועסקים במשמרות לילה, גם אם בפועל, נוכח האיסור שבחוק, הוא מסב את עבודתם למשמרות יום. בית הדין סירב לזכות העובדות שהוסבו לעבודת יום בפיצויים בגין ההרעה בתנאי העסקתם ובג"צ קבע כי ראוי לה למערכת משפט הגונה, שתבדוק את עצמה בכל עת, בין בשל שיקול נוסף ובין בשל טעות ועל כן רשאי בית הדין לסטות מהלכה קודמת שלו, אף שאין הדבר מובן מאליו.
