בית המשפט העליון, בערעור על פסק דינו של בית המשפט לעניינים מנהליים, קיבל את הערעור בנושא המחלוקת מול מנהל מקרקעי ישראל בשאלה מהו המועד ממנו יש למנות את 50 הימים לתשלום הוצאות הפיתוח במסגרת מכרז להחכרת מגרשים לבניה עצמית. בית המשפט קבע, כי למרות ההקפדה בדיני המכרזים, במקרה דנן הייתה אי בהירות בניסוח מסמכי המכרז אשר הובילה לטעות של המערער במימוש זכייתו, באשר המערער חשב כי יוכל לשלם את הסכום בתוך 50 ימים מקבלת ההודעה על הזכיה ולא ממועד הזכיה עצמה. בנסיבות מיוחדות אלה, כאשר תוכנו של ההסכם מגובש וחלק נכבד מן התמורה שולם, קבע בית המשפט כי רואים פעולות שצד מנע את ביצוען (וביתר שאת חל הדבר כאשר אותו צד הוא בגדר רשות והעומד מולו הוא "האזרח הקטן") כאילו בוצעו במועד מכח עקרון תום הלב. לפיכך, אין כאן גם חריגה מעקרון השוויון, במשמעותו המכרזית.
