ביום 15 יולי, 2009, נתקבלה החלטה מפי כבוד השופט ד"ר עמירם בנימיני בעניין בקשה לאישור תובענה מינהלית ייצוגית כנגד עיריית תל אביב אשר נסובה סביב שאלת חוקיות תעריף הארנונה שגבתה העירייה בגין 100 מ"ר הראשונים של נכסים המסווגים כתעשייה. המבקשת טענה כי תעריף לפיו חויבה ושנעשה בפועל בין השנים 2005-2006 הינו גבוה וחורג מהוראות חוק הסדרים במשק המדינה (תיקוני חקיקה להשגת יעדי תקציב), התשנ"ג -1992 והוראות תקנות ההסדרים במשק המדינה (ארנונה כללית ברשויות המקומיות בשנת 2000), התש"ס-2000, אשר קובעות תעריף נמוך יותר למ"ר בנכס בסיווג של תעשייה. בית המשפט התרשם כי העיריה היתה מודעת לחריגה מן התעריף המירבי שנקבע בתקנות ההסדרים, חריגה שהינה בניגוד לחוק, ובהתאם לרוח תכליות חוק תובענות ייצוגיות, אשר באות לידי ביטוי גם ביחסי האזרח עם הרשות הגובה תשלומי חובה. עוד קבע כי אכן מתקיימים התנאים להכרה בתובענה שכזו כייצוגית וכן אף מתגשמת התכלית למימוש זכות הגישה וקבלת סעד יעיל לאזרחים רבים אשר נפגעו ממעשי הרשות, אך לא היו טורחים או מעיזים להתמודד עם הרשות בגין נזק שאינו גדול יחסית, אלמלא קיומו של מכשיר התובענה הייצוגית, לאור החליט בית המשפט כי יש מקום להכיר בתובענה זו כייצוגית.
