בית הדין הארצי לעבודה בירושלים דחה ערעור על פסק דין אשר דחה תביעה לפיצויי פיטורים וזכויות סוציאליות. בית הדין האזורי קבע, על פי המבחנים המקובלים לעניין קביעת מעמדו של עובד, מבחן ההשתלבות ומבחן הקשר האישי, כי בין הצדדים לא שררו יחסי עובד-מעביד, וכי ההתקשרות הייתה לקבלת 'שקט תעשייתי' תמורת 'דמי חסות -פרוטקשן' וכך אין המדובר בקשר אישי למרות שתשלום דמי החסות היה באמצעות תלוש שכר. עבודת "השמירה" נעשתה גם על ידי בני משפחה אחרים, המערער לא החתים כרטיס נוכחות, לא דיווח על שעות העבודה, לא קיבל מהמשיבה ביגוד, וציוד אחר הדרוש לצרכי השמירה, לא פנה למפקח לבקש לצאת לחופשה או להיעדר והמשיבה לא פיקחה כלל על עבודתו כלל.
