עיריית חולון הורתה לארבעה תושבים, בעלי איטליזים, להסדיר את פינוי האשפה מבתי עסקיהם באופן עצמאי על דרך של מתן הוראה לפינוי עצמי. התושבים הגישו תביעה כנגד העירייה ועתרו לקבלת פיצויים בגין גרם נזק עקב מחדלה של העירייה, בטענה כי אי פינוי אשפה סמוך למקום עסקם, על אף שהם נושאים בתשלום ארנונה באופן שוטף, הינה הפרת חובתה הסטוטורית של העירייה לפינוי אשפה מכוח סעיף 242 לפקודת העיריות [נוסח חדש]. בית המשפט דחה טענת התובעים וקבע כי לפי הוראות הפקודה העירייה אמנם רשאית לפנות את האשפה באמצעות עובדיה או באמצעות גורמי משנה, תוך גביית אגרה עבור השירות ואולם, אין בכך כדי לחייב את העירייה לבצע תמיד את הפינוי בעין. קרי, לעיתים ישנם מצבים מיוחדים בהם הטלת נטל הפינוי על בתי העסק עצמם יהיו מוצדקים בנסיבות העניין. בית המשפט סבר כי אין מקום להתערב בשיקול דעתה של העירייה, אשר לטענתה פינוי מבתי עסקיהם של התובעים יגרום לנטל מכביד ובלתי סביר, הן במישור המעשי והן במישור התקציבי.
