אחד התחומים בהם עוסק משרדנו הינו כינוסים ופירוקים ונושא זכויות הנושים מול זכויות החייב לאור חוקי היסוד, הוא נושא התופס מקום של כבוד בתחום זה. בהליך בו עוסק פסק דין זה, הגיש נאמן לנכסי פושט רגל בקשה חסויה (בקשה אשר לא הוצגה אף לבעלי הדין האחרים) לפיה נתבקש צו המאשר לנאמן לתפוס כבר בגן האירועים מתנות אשר יקבל פושט הרגל בטקס הנישואין וזאת תוך שימוש בשירותיו של "בעל תפקיד" מורשה ושוטרים בתשלום. כב' השופט שפירא סקר את ס' 42 לפקודת פשיטת הרגל הקובע כי נכסי החייב מוקנים לנאמן, המשיך ועמד על פרשנותו של סעיף 85(1) לפקודה הנ"ל המגדיר את נכסי החייב והגיע למסקנה כי לכאורה על המתנות האמורות לעבור לרשות הנאמן. לבסוף קבע בית המשפט, כי הגם שכספי מתנות של פושט רגל מוקנים לנאמן, יש להשיגם בדרך ובאמצעים שלא יפגעו בצדדים שלישיים, בסבירות ובמידה הראויה וכי עלות התהליך תהיה סבירה ביחס לתוצאה הנדרשת הימנו. כך, דחה בית המשפט את בקשת הנאמן.
