התובעים רכשו מהחברה דירה בפרוייקט בנייה וצוין בפניהם שטח הדירה כ 84 מ"ר ברוטו. לאחר כעשר שנים דרשו הקונים פיצוי מכיוון ששטח הדירה הינו 63 מ"ר נטו בלבד. בית המשפט העליון, כבוד השופטת עדנה ארבל, דחה אמנם ערעור של רוכשי דירה על החלטה שלא לזכותם בערעור, אולם הביע מורת רוח על הפסול שבציון שטח "ברוטו" של דירה, על ידי מוכרי הדירה (קבלן/ משווק). עם זאת לא ראה בית המשפט מקום בנסיבות המקרה (דירה שנמכרה עוד בשנת 1992) לחייב את המוכר בפיצוי אלא דחה את יישום מורת הרוח למקרה מתאים יותר. במקרה דנן קבע בית המשפט המחוזי (ובית המשפט העליון לא התערב בכך) כי לא קיימת זכאות לפיצוי מכיוון שהוצג למבקשים תשריט שיווקי אשר היה מצוין עליו רוחב הדירה ואורך הדירה כאשר מכפלה פשוטה של נתונים אלו היתה מלמדת כי מעטפת הדירה הינה בשטח של 7מטרX9 מטר, דהיינו 63 מ"ר.
