בית המשפט דן לאחרונה בעתירה אשר הוגשה על ידי חברה פרטית, אשר שכרה נכס במתחם האוניברסיטה העברית בירושלים וקיבלה דרישה לתשלום ארנונה, כאשר האוניברסיטה, הרשומה כמחזיקה בנכס ברישומי העירייה, נמנעה מלהודיע בדבר העברת החזקה. העותרת טענה, כי הודעת החיוב אשר נשלחה אליה מהווה חיוב רטרואקטיבי אשר בטל מעיקרו וכי האחריות להודיע על העברת ההחזקה הינה על בעל נכס וכי יש לחייב את בעל הנכס בתשלום ארנונה עד למועד מסירת ההודעה בדבר העברת החזקה. בית המשפט קבע, כי אין מדובר בחיוב רטרואקטיבי אסור אלא רק בתיקון רטרואקטיבי מותר של רישומי העירייה בנוגע לזהות המחזיק בנכס שבתחומה. בנוסף, מאחר והעותרת הינה גוף עסקי, סביר כי ידעה או למצער הייתה צריכה לדעת כי כמחזיקה בנכס, חלה עליה החובה לשלם את הארנונה. מאחר ובית המשפט התרשם כי העותרת בחרה לעצום עיניה ולהתעלם מחובתה, דחה העתירה בקובעו כי יש להעדיף האינטרס הציבורי לגביית מס אמת על האינטרס האישי של העותרת לא לשלם ארנונה עבור שנים קודמות.
