בית המשפט לעניינים מנהליים בחיפה ביטל החלטת ראש מועצה להפסיק כהונת חבר מועצה בשל אי תשלום חוב חוב ארנונה והיטל ביוב. סעיף 120(10) לפקודת העיריות [נוסח חדש], קובע כי חברותו של חבר מועצה, אשר לא הסדיר את חובותיו לעירייה, תופסק. במקרה דנן, ראש העיר הודיע לעותר, כי בשל אי הסדרת החוב במועד ובמסגרת סמכות המוקנות לו לפי סעיף 123 לפקודת העיריות מופסקת חברותו במועצת העיר. בית המשפט קיבל את העתירה וציין, כי הזכות לבחור ולהיבחר לרשות המחוקקת ולרשויות המקומיות היא זכות יסוד ולכן, הפסקת כהונה של נבחר ציבור צריכה להיעשות רק בנסיבות קיצוניות. במקרה דנא אין מדובר בנסיבות קיצוניות ועל כן הורה על הארכת המועד וביטול החלטת ראש העיר.
