בית המשפט העליון דן לאחרונה בעתירה אשר עניינה ביטול חוק עזר עירוני בתחום שירותי השמירה והביטחון, אשר מכוחו גבתה העירייה אגרה למימון פעילותם של סיירים חמושים למען הגברת הביטחון ברחובות העיר. בשאלת סמכותה של העירייה להפעיל סיירת שייעודה ביטחוני בחר בית המשפט להימנע מהכרעה מפורשת בשאלת הסמכות על אף שקבע כי כף המאזניים מתנדנדת ונוטה לכיוון היעדר סמכות,. בשאלת אמצעי המימון הראוי למתן שירותי ביטחון עירוניים קבע בית המשפט כי היטל מיוחד הוא אמצעי ראוי למימון השירות, שכן לכך יתרונות בולטים ובכלל זה ישנה אפשרות לעקוב אחר הכספים שנגבו ולהבטיח שנעשה בהם שימוש לצרכים אשר לשמם הם נגבו. לבסוף, בשאלת הליך אישורו של חוק העזר הספציפי קבע בית המשפט כי החלטות משרד הפנים בעניין אינן סבירות, הן במישור קביעת המדיניות והן באישור חוק העזר. בית המשפט קבע כי חוק העזר בטל, וזאת בגדרי בטלות יחסית, קרי העירייה לא תורשה עוד לגבות כספים מהתושבים מכוח חוק העזר נשוא העתירה ואולם לא תידרש להשיב את הכספים שנגבו עד עתה.
