City can evacuate a stand even if paid city tax for years

לפני ימים אחדים נדונה עתירה מנהלית אשר עניינה חוקיות החלטת עיריית ירושלים לפנות דוכן אשר מהווה "מכשול ברכב", או בשפה המשפטית, הצבתו נוגדת את סעיף 39(א)(1) לחוק העזר העירוני. יוטעם, כי הדוכן עומד במקומו ומופעל על ידי בעליו מזה שנים רבות. לא זו אף זו, בכל אותן שנים בהם הופעל הדוכן הקפידה העירייה לגבות מבעליו מיסי ארנונה. העותרת טענה, כי העירייה נהגה בחוסר תום לב קיצוני בכך שבידה האחת גבתה ממנה במשך שנים תשלומי ארנונה בעד הדוכן ויצרה על ידי כך הסתמכות מצדה בדבר קיומה של זכות שימוש בדוכן, ובידה האחרת דורשת ממנה לפנות את הדוכן בשל היותו "מכשול ברחוב".

בית המשפט דחה את העתירה וקבע, כי גביית ארנונה בעד התקופה בה הדוכן היה פעיל ושימש לרוכלות – גם אם בלא רישיון – אינה נתון המונע מהעירייה להפעיל את סמכותה על פי חוק העזר
