מעביד ניכה משכרם של עובדים כספים לטובת הפרשות לקרן הפנסיה. לימים התגלה כי המעביד ‏לא העביר את הכספים האמורים במועדם, אלא בחלוף למעלה משנה וזאת עקב מצוקה כלכלית ‏אליה נקלע. בית הדין הרשיע המעביד בעבירה של אי העברת כספים על ידי תאגיד ועל בסיס הרשעה ‏זו הוגש כתב אישום גם נגד נושא משרה בתאגיד, מנהל פעיל שהיה אמון על הפן הכספי, וזאת בגין ‏עבירת התאגיד. בית הדין לעבודה קבע, כי הוכח שהמנהל עשה ככל שביכולתו למניעת העבירה, ‏שכן ברגע שנודע לו שיש בעיה של איחורים, ישב עם מנהל קרנות הפנסיה והגיע איתם להסדר. ‏משכך, בית הדין לעבודה זיכה את המנהל מהעבירות המיוחסות לו.‏
