בית המשפט העליון דחה בקשת רשות ערעור על החלטת בית המשפט המחוזי לדחות ערעור על החלטת בית המשפט השלום בירושלים בתביעה כנגד בנק הפועלים בגין, בין היתר, אי פיקוחו על הלוואה שנתן לשתי חברות ושמבקשי הערעור הפקידו כנגדה בטוחה. לאחר שנקלעו שתי החברות לקשיים חילט הבנק את כספי המבקשים, וכן את כספם של משקיעים אחרים אשר הפקידו בטוחות. המבקשים העלו מספר טענות כנגד הבנק ובין היתר כי קיימת היתה חובה על הבנק לפקח על התקדמות הפרוייקט בגינו נתנו בטוחה. בית המשפט קבע כי במסמכי הבטוחה לא הייתה תחייבות מצד הבנק ללוות את הפרוייקט בדרך שתבטיח את השקעת המשקיעים. השופט רובינשטיין הבהיר לעניין זה, כי אכן בנקים חבים חובת נאמנות ללקוחות אשר דורשת מהבנק לפעול ביושר, באמינות ובמקצועיות, תוך שאינו מנצל שלא כהלכה את כוחו ויתרונותיו. עם זאת, גם לחובה זו גבולות הנובעים מסוג הפעולה שהבנק מבצע, סוג הלקוח, טיב הקשר שבין הלקוח לבין הבנק, מידת הסתמכותו של הלקוח על הבנק ומבחני עזר נוספים.
