A person made a notarial will, in which he replaced the beneficiaries from his ex-employer to his sister and her children.
The Court probated the will. Israeli law stipulates that every person is competent to make a will unless their legal capacity to has been revoked or if he does not understand its meaning at the time of execution. In the case of a will made before a notary for a hospitalized/bedridden person, an up-to-date medical certificate from the date of the action is required. Here, the notarized will was indeed executed during the deceased's hospitalization, but the notary met with him twice and ensured that a specialist physician examined him on the day the will was drawn up and issued a medical certificate confirming his capacity. Therefore, the second will be the valid will, and the sister is the heir.
