An employee was involved in a car accident on her way home after finishing her workday, but cellular location data, the actual travel route, and the significant time gap between leaving work and the occurrence of the accident indicated that the location and time did not align with the accepted route from the workplace to her residence.
The Labor Court held that it is not considered a workplace accident and thus the employee is not entitled to social security benefits. An employee injured in a workplace accident is entitled to Social Security benefits. Generally, the Israeli National Security Law recognizes also an accident that occurred on the way from work home as a work accident, provided there was no substantial interruption or deviation from the accepted route from work to home that is unrelated to the fulfillment of the employee's duties to its employer. Here, the accident occurred off the accepted route to the employee's home or alternatively during a substantial deviation from it. Therefore, the accident is not considered a workplace accident.
