Loss of value of land is not grounds for cancellation of contract absent fraud

אדם חתם על מספר הסכמים לרכישת קרקעות ברומניה באמצעות משווק של חברה העוסקת בתחום וזאת ללא כל בדיקה מקדימה של פרטי העסקה ועל בסיס המלצת אדמו"ר. לאחר קריסת שוק הנדל"ן הרומני ביקש הרוכש לבטל את ההסכם בטענה כי הוצאו ממנו כספים במרמה וכי מסמך אישור הזכויות שהוצג לו עובר לביצוע העסקה חסר כל תוקף. 

בית המשפט קבע ש אין לרוכש להלין אלא על עצמו מאחר שלא בדק אישית את טיב העסקה, לא טרח לטוס לרומניה ולבדוק את הדברים מקרוב, ואף לא שכר את שירותיו של מומחה שיבדוק עבורו את העסקה, ובפרט אם החברה רכשה קרקעות ואם זכויותיו נרשמו בספרים, כפי שעלה ממסמך האישור, אלא ראה לנכון להסתמך על אישור שקיבל מהאדמו"ר לביצועה של העסקה.
