העותרת התאלמנה מבעלה בשנת 1996 והחלה לקבל קצבת שארים מביטוח לאומי. בשנת 1998 עברה להתגורר עם בן זוגה הנוכחי תחילה בדירה שכורה ובהמשך בדירה שקנו יחדיו. הזוג לא נישא מעולם אך בשנת 2002 צירפה העותרת את שם משפחתו של בן זוגה לשם משפחתה ואף נולדו להם שני ילדים. מידע זה הועבר למוסד לביטוח לאומי וזה הפסיק את קצבת השארים של העותרת. בית המשפט העליון קבע כי קצבאות שאירים ותלויים תכליתן לפצות על אובדן התמיכה הכלכלית שהייתה נתונה לאדם מבן זוגו כמי שהיה תלוי בו בהקשר זה ולשמר את רמת חייו פחות או יותר כפי שהייתה לפני פטירת בן הזוג. השאלה לעניין הענקת זכויות כמו גם לעניין פקיעתן היא האם קיים באותה סוגיה שוני רלוונטי בין בני זוג נשואים כדת וכדין לבני זוג החיים כידועים בציבור. בית המשפט העליון קבע כי לא קיים שוני כאמור ולכן בנוגע לפקיעת הזכות לקצבאות שאירים או תלויים יש להחיל דין זהה על אלמנות החיות כידועות בציבור ועל אלמנות אשר חזרו ונישאו כדת וכדין ולכן, הפסקת קצבת השארים לעותרת הינה מוצדקת.
