An employee became ill and when returned to work discovered that another employee had been employed instead of her. The employee filed a claim on the grounds that she was dismissed immediately and without a hearing and demanded her full rights.

The Labor Court held that the employer terminated the employee and the employee did not quit because the employee came back to work upon the end of her sick leave and was fired without prior notice and without a letter of dismissal. Therefore, the employee is entitled to payment of her full rights.
