An employee in a cookie factory worked for about 7 years under three different plant owners and in different locations until she quit in order to take care of her baby. The parties disputed as to when the employment period commences – from the beginning of employment at the factory or when the last plat owner took over.
The Court held that the question is whether there was, in fact, a change of employers. The Court held that the employer did not update the employee of the change of employer entity and the employee was unaware of that. It was proved that continuity of employment applies from the beginning of employment until the date of resignation and thus the employee is entitled to her rights from the beginning of her employment at the factory.
