בקשת העותרת לצו מניעה נדחתה על ידי כבוד השופטת רונן בתחילת אוגוסט 2008. כבוד השופט מודריק קבע השבוע (4.1.2009) כי לכאורה היה עליו לקבל את העתירה ולבטל את המכרז, אולם כעת, חמישה חודשים לאחר מכן, עבודות המכרז מתבצעות בידי הזוכה וביטול המכרז יגרום להוצאות כפולות ומכופלות אשר יוטלו על קופת הציבור. על כן יש לראות את הדברים כ"מעשה עשוי" גם אם עבודות המכרז לא הגיעו לכלל השלמה. השופט מודריק דחה מסיבה זו את העתירה אולם חייב את המועצה האזורית בהוצאות העותרת וקבע כי על המועצה האזורית לנהל מו"מ עם העותרת על פיצוי מסוים בגין העובדה שהזכייה במכרז לא נמסרה לה.
