בעתירה לדיון נוסףבהחלטת בית המשפט העליון(כב'המשנה לנשיאה א' ריבלין והשופטים: ס' ג'ובראן,י' אלון) מיום 27.3.2008 ברע"א65/06, קבעה כב' הנשיאהבייניש כי אין מקום לדיון נוסף בנושא והיא מותירה על כנה את החלטתו הקודמת של בית המשפט.משמעות ההחלטה הינה כי יחיד (או עוסק מורשה, להבדיל מחברה) אינו יכול משפטית לשעבד את נכסיו בשעבוד צף.להבדיל משעבוד קבוע, אשר מונע כל פעולהבנכס המשועבד, שעבוד צף מרחף לו כענן מעל הנכסים המשועבדים (למשל מלאי, או כלל נכסי החברה) ומתגבש למעין שעבוד קבוע רק עם הפעלתו על ידי הנושה.משמעות הדבר היא יכולת תפקוד רחבה יותר של בעל הנכס ותוצאת ההחלטה של בית המשפט העליון היא בעיקר פגיעה ביכולת קבלת מימון עלידי עסקים קטנים, אשר אינם מאוגדים כחברה
