בית הדין האזורי לעבודה דן לאחרונה בבקשה להורות על ביטול מכתב התפטרות עליו חתם עובד, בטענה כי התפטרותו נעשתה בנסיבות של "עידנא דריתחא". בית הדין ציין, כי ההלכה קובעת שהאקט המביא לסיום יחסי עבודה חייב להיות חד משמעי. כך, לא תעמוד לחובת עובד אמירה בדבר התפטרות ש"בעידנא דריתחא" וכתוצאה מכך יפסיד פיצויי פיטורים. באותו אופן, לא תעמוד לחובת מעביד אמירה ש"בעידנא דריתחא" כי מפטר הוא את עובדו וכתוצאה מכך יחויב בתשלום פיצויי פיצויים. במקום בו האמירה נאמרה "בעידנא דריתחא", אומר האמירה רשאי להעמיד את הצד השני על כוונתו האמיתית תוך זמן סביר. בענייננו, בית הדין קובע כי אין מדובר בנסיבות קלאסיות של "עידנא דריתחא", אולם לאור המצב הנפשי בו היה נתון העובד; העובדה כי המעביד הותיר בידי העובד זכות בחירה מצומצמת ומשלא ניתנה לעובד אפשרות להתייעץ טרם החלטתו- מדובר בהתנהלות החורגת מיחסי עבודה תקינים. לא זו אף זו, העובד העמיד את המעביד על כוונתו האמיתית עוד באותו היום, עת חזר בו מהודעת ההתפטרות. בית הדין החיל את הלכות "עידנא דריתחא" ובתוך כך קבע, כי המעביד אינו רשאי לסיים את העסקת העובד ללא קיום שימוע.
