בית הדין האזורי בחיפה, כבוד השופטת דלית גילה, דחתה תביעת עובד שהתפטר לפיצויי פיטורים בטענה של הרעה מוחשית בתנאי עבודתו בהסתמך על סעיף 11(א) לחוק פיצויי פיטורים, התשכ"ח – 1963 וקבעה כי על מנת שייכנס התובע לחלופה הקבועה בסעיף 11(א), עליו להראות כי הייתה "הרעה מוחשית" בתנאי העסקתו ואין די בהרעה סתם. המבחן לקביעת ממשיות ההרעה, הוא מבחן אובייקטיבי, מבחן האדם הסביר, ואין די בתחושתו הסובייקטיבית של העובד כי תנאי הורעו. עוד נדרש כי ההתפטרות הייתה פועל יוצא של אותה הרעה - אם התפטר העובד מסיבות אחרות אף אם התברר בדיעבד כי הייתה קיימת הרעה מוחשית בתנאי עבודתו (המעביד לא העביר את תגמולי הביטוח לפוליסה) אין התפטרות כאמור נכנסת בגדר הסעיף. על העובד חלה חובה להתריע בפני המעביד על כוונתו להתפטר בשל ההרעה ולאפשר למעביד לתקן. הדבר נובע אף מכוח חובת תום הלב הקיימת בדין הכללי.
