A municipal parking report did not reach its destination on time and its existence was learnt only upon receipt of an increased debt demand. The municipality rejected the debtor's request to cancel the report and imposed a lien on the debtor's bank account.
The Court held that the municipality was negligent when it failed to send the original report to the debtor and continued collection proceedings without referring to his requests. However, there is a contributory negligence by the debtor as upon not receiving an answer, he failed to take appropriate legal action and idly waited until after a lien was imposed. In light of the above, the debtor's demand for compensation for damage to his reputation due to the imposition of a lien on his bank account was rejected.
