The purpose of criminal law is not to "price" the offenses, but to prevent them. Rehabilitation attempts to prevent the commission of offenses while focusing on social interests beyond the defendant and the severity of his actions. This is a desire to turn the defendant into a law-abiding citizen who integrates into the community in which he lives without imposing a risk on it (see in this regard: Livni, White-Collar Offenses, p. 21).
In other words, the sentence can be reduced even in cases where the defendant has already been rehabilitated, moves on to sentencing, and also in cases where there are real chances of rehabilitation in the future. This is presented at this stage, within the considerations for determining the punishment compound and not as a reason for deviating from it, but in order to show the importance of rehabilitation, which allows for any deviation from the punishment range that has been determined (see in this regard, the words of the Honorable Justice Elyakim Rubinstein in the matter of relief in paragraphs 13-14 of his judgment see also: Oren Gezel-Eyal, "Developments in Procedural and Substantive Criminal Law 2012-2014", Din Ve-Devarim I. 517, 548 (2016), which insists that it is important that the change in Amendment 113 be assimilated in the substantive sense, so that, for example, the chances of rehabilitation will be preferred).
6.2.2 Importance of Rehabilitation in the Case of Corporations
In the case before me, the main reason for supporting the plea bargain was the rehabilitation that the defendants underwent and the change in ownership. Both sides emphasized that these are in fact the same legal entities, the same "shell," but with completely different content. In the context of punishment and rehabilitation, corporate law also places considerations that arise alongside penal law that arise when it comes to human beings, leading to the conclusion that in the case of corporations that have committed crimes, the principle of rehabilitation should be preferred.
