Defendant 9, Mr. Gabriel Klein (hereinafter: Mr. Klein or Defendant 9), responded to the indictment and denied most of the allegations attributed to him, but confirmed what was stated in this paragraph. Mr. Klein has served as CEO of Via Arcadia and Super Ceramics since 2013 and was a member of the management of the Negev Ceramics Group. As part of his position, he signed the financial statements of Via Arcadia and Super Ceramics. Mr. Klein's salary was influenced by the performance of Via Arcadia, of which he was one of its founders, as well as the performance of Super Ceramics and their meeting of their sales and delivery targets.
Defendant 10, Mr. Yaakov Grohar (hereinafter: Mr. Grohar or Defendant 10), also responded to the indictment and denied most of the allegations attributed to him, and confirmed what was stated in this paragraph. Mr. Grohar, an accountant by profession, served as CFO of Via Arcadia and Super Ceramics throughout the period that Negev Ceramics owned. Mr. Grohr began serving as CFO of Via Arcadia even before it was acquired by Negev Ceramics. By virtue of his position, he signed their financial statements and was responsible, among other things, for collecting money from their clients.
Ms. Meira Ben Yosef, Defendant 11 (hereinafter: Ms. Ben Yosef or Defendant 11) has worked at Negev Ceramics since 1992 and served as VP of Human Resources at Negev Ceramics Group and Africa Israel Industries, since 2013. A hearing on her case is scheduled for today.
2.2. On the Offenses Attributed to the Defendants
Again, I will mention that the offenses attributed to the defendants are according to what is written in the indictment, and according to it alone, subject to confessions or denials as stated above.
During the period relevant to the charges, Mr. Motola and Mr. Ivshitz took advantage of their position in the group in order to instruct their subordinates to carry out fraudulent actions that would misrepresent the results of the Negev Ceramics Group and its compliance with the high goals set for it.
