We reiterate that the payment of the rent and the maintenance and maintenance of the property are the basis of the agreement, and first and foremost.  Yaakov is waiting for Mr.  Luzon to return to him" (emphasis added).

  1. On November 10.In 2020, a long email was sent to the defendant by the company's attorney (page 144 of the company's attorney's affidavit) in which she once again mentions the delay in the works. She notes that in her experience, the municipality does work during these months, and there is no room for showing patience towards delays when the delay is so dramatic.  It also notes about the certificates: "As for the certificates that you explain that you have already presented, I went through the update you sent again and did not see the aforementioned certificates, but I did see your notice that approvals have not yet been issued from the Ministry of Health/Conservation Department." She further notes that although they reached a payment arrangement with the tenant, she did not comply with this arrangement either, when she did not deliver the checks that she was required to deliver according to the agreement, by the time of the letter.  And in section 9 of the email, it is written:

"We reiterate that you pay your debt immediately and submit checks for the minimum rent immediately , otherwise our company will be forced to resort to collection proceedings and to fully exercise its rights according to the agreement and the law.

Your debt as of the date of writing is ILS 374,000 plus VAT as per law, this debt includes rent for the months of October + November 2020 + ILS 58,000 plus VAT debt for an arrangement that was supposed to be paid in October + ILS 56,000 plus VAT for an arrangement that was supposed to be paid in November 2020.

In addition, you are requested to immediately submit checks for the next 12 months of rent, as well as a check due for December 2040 in the amount of + ILS 56,000 VAT, the last payment to the arrangement" (emphasis added - p.  R).
