It appears from the conversations that defendant 1 planned to steal the drugs from the deceased even before he brought defendant 2 in the secret of the matter, after the deceased told him on 21 February 2018 that he had drugs that he had to "kick out" and that he needed money (call 18-52-00). Already on February 22, 2018, at 2:42 P.M., after ascertaining when the deceased was leaving the house, defendant 1 contacted another (referred to by him as "Ahshalu called the neighborhood next door"), and coordinated a meeting with him that required hats or a warm neck; Although the meeting did not take place, in a conversation that took place between them at 7:07 p.m., Defendant 1 clarified that the deceased (whom he gave his full name) had close to 100 grams in the house and that he "wants it not to be for him. period" (Talk 19-05-42). On the morning of February 25, 2018, defendant 1 spoke with the deceased again, inquired when he was working and verified the amount of drugs with him (call 10-35-27), and immediately afterwards called "Ahshala Neighborhood Nearby" and informed him that they would leave after the deceased left for work (call 10-41-05); But at 17:23, the other decided to cancel the program (talk 17-23-50).
A few minutes later, at 5:27 P.M., Defendant 1 is heard calling Defendant 2 and asking to talk to him "downstairs" (according to the conversations, they are both at work), informing his girlfriend that his friend will be coming to them in the evening, and that around one he will have to disappear for half an hour or so; and at 5:57 P.M., he tells Defendant 2 that he needs him for something "good, profitable" in Sderot (Conversation 20, B/27, pp. 54-55). At 18:09, defendant 1 had a conversation with the deceased, told him that he was coming with someone, and expressed his displeasure that the deceased would not be alone (conversation 18-02-33 from 07:02). As stated, on the same day (25 February 2018), the first meeting took place between the defendants and the deceased, in which they saw and tasted the drugs, and afterwards, after the deceased went to work, they tried to break into his home in order to steal the drugs, as Defendant 1 had planned in advance.
