To the question of how the deceased was when they returned to the car, defendant 1 replied that he was still unconscious, and to the question of why he did not call MDA, he replied that he was afraid "of everything at that moment, I did not know what to do, who I am and what I am", and that defendant 2 also did not raise the idea of calling MDA (ibid., at paras. 149-156).

During the confrontation , Defendant 1 claimed that after beating the deceased, Defendant 2 said that they had to burn the car and the body so that there would be no evidence; they dragged the deceased into the car, put him in the car, but "it was as if he didn't exactly sit like that, he dropped forward like that with the head and the area of that side"; and after searching and finding Defendant 2's glasses at the scene of the incident but did not find the keys to his house that were lost,  They went to buy gas, a lighter and a flashlight to look for the keys.  When they did not find a flashlight at the two gas stations, he lit a jerrycan they found on the way and defendant 2 helped him, and they returned to the scene.  Defendant 2 said that they had to move the car inside so that they wouldn't see it, he lifted the handbrake to push it, but the steering wheel was locked and the car got stuck in one of the stones.  According to him, Defendant 2 "brings me the jerrycan, tells me to pour it, I started pouring inside, everywhere, on the body, on everything, I try at first to light it, I can't, there was also rain...  After that I don't, I can't light the paper, it doesn't turn on...  [Defendant 2] saw that he had perfume in the chamber of...  On the side of the door, he sprayed on the paper, I grabbed the paper...  I turned on the paper.  And I threw it in...  to the driver's area"; Defendant 2 threw the perfume into the car, and they fled the scene.  Defendant 1 recounted how, during the escape, defendant 2 fell into possession of the deceased's phone, which they had taken from his pocket while towing and which they used to search for the keys (P/8A, pp. 11-15).
