Regarding the planning and events that preceded the event

During the interrogation of Defendant 2 by the Commander of the Intelligence Unit on February 28, 2018 at 20:40 (CD P/11A, transcript P/11; It should be noted that some of the quotes that will be quoted below do not appear in the transcript, but are clearly heard on the interrogation documentation CD (P/11A), defendant 2 said that "the person with whom I did this wanted to kill the person because he took the drugs...  He needed me so that I would be the intermediary between the purchase and the person so that he would not show him a suspect that he would take him down" (as noted, at this stage Defendant 2 did not explicitly name Defendant 1).  When asked how he did it, he replied, "He told me to take a walk with him somewhere...  Areas like that, I don't remember where he took it...  He told me to go with him to the side, I'll come to him from behind...  We will bring him a blow to the head and we will go" (P/11, p. 3, s. 37 to p. 4, s. 18).

He later said that he did not know that "he" intended to kill the deceased and would not have consented to it, and that the plan was to buy drugs from the deceased and go to the point where they would bring him the money.  When asked if he was sure of this, he replied that on Sunday "he" told him that he wanted to kill the deceased, and in response, defendant 2 said , "No, let's scare him, let's scare him so that at least he runs away from the city, I'm not a person who kills"; and on Monday, "he" told him that they meet with the deceased, buy from him and transfer the money to him, so it surprised him when he "dismantled" him.  Defendant 2 replied that after the incident he asked the accomplice why he did it, and he told him , "Shut up, it's money, it's drugs"; and confirmed that the murder took place because of the 75 grams of drugs, which "he" could sell (ibid., pp. 7-9).

In the interrogation following the conversation with the Commander  of the Central Intelligence Unit, dated February 28, 2018 at 21:19 (Message P/12, Disc P/12B, Transcript P/12A), after he was warned on suspicion of committing offenses of conspiracy to commit crime and murder, and was asked to respond to the suspicions and repeat what he had said in the conversation with the Commander of the Intelligence Unit, Defendant 2 said that Defendant 1 approached him at work and told him that there was a person who was trying to sell drugs and was not going to him.  and "he wanted to make a move to sting him everything," so they went to meet the deceased on Sunday.  They met with the deceased at his home, talked to him about quantities and prices, and the deceased showed them the drugs – 75 grams of cannabis; Afterwards, defendant 1 wanted them to break into the deceased's house and steal the drugs, and a few hours later they did arrive at the house of the deceased, who was at work but could not enter the house, when defendant 1 tried to climb through the window and enter through the door but did not succeed, while he kept that no one came (P/12 Qs 9-15, Qs 35-38).
