With regard to the offense of threats, the defendant violated the protected social values of human dignity, peace of mind and personal security of the public servant who performs the work, and his ability to fulfill his duties without fear, in public order and in the rule of law.
In the first charge in the attached file, the offense of receiving a stolen vehicle causes damage both to the individual, while harming his personal property and his sense of protection, and to the entire public, which is required to consolidate claims at higher insurance premium costs. The purpose of section 413J of the Penal Law is to deter the receipt or possession of a vehicle that was obtained illegally, and to consolidate claims in order to indirectly reduce the consolidation of claims and the temptation to steal vehicles, since car thieves use others to detain them until the end of the proceedings.
The legislature set a maximum penalty of up to 7 years in prison alongside this offense, andthe consolidation of claims as part of the legislation designed to combat the phenomenon of vehicle theft.
In addition, the defendant drove the stolen vehicle without a valid driver's license, since his license had expired from a financial case two years earlier, and without insurance that covers this driving, thus harming the social value of the protection of the financial case – the safety of road users, who may find themselves in the defendant's lane of travel and be harmed, whether as passengers in the vehicle or as pedestrians, without the ability to repay it, which means that an economic burden will be imposed on the top of the state's coffers.
In the second charge in the attached file, the defendant violated the protected social values of human dignity, peace of mind and personal safety of the public servant performing the work, as well as his ability to perform his duties without fear, in public order and in the rule of law.
The extent of the violation of the social values protected by any of the three incidents, in light of their circumstances, is significant and real, but it is not at a high level. In practice, no real injury was caused to any of the police officers or passersby, and even the stolen vehicle was returned to its owner.
