Molotov cocktails thrown at the scenes of Sheikh Jarrah, the post office, Bank Leumi, Mercantile Bank and the court - summary
- In light of the objective evidence presented, including the security camera footage, taking into account the identification of the defendant by the various identifying witnesses, the items seized at the meeting and the comparison of the security camera footage, taking into account the version given by Shimon to the police about the circumstances preceding the Sheikh Jarrah incident, and in view of the defendant's silence, I determine as a finding of fact as follows:
On the evening of 9 October 2023, the defendant, together with Shimon, prepared to throw Molotov cocktails. The defendant and Shimon went to the gas station on Third Wall Street in Jerusalem, where Shimon filled a one-and-a-half-liter bottle with gasoline, according to the defendant's intentions, after Shimon asked Yehoshua for fuel for a motorcycle that was stuck, and he received the gasoline from Yehoshua for free. Later, the two went to the grocery store where the defendant bought several bottles of beer, and then the two returned to the Mahane Israel yeshiva, where they parted. The defendant prepared several Molotov cocktails using the gasoline and beer bottles he bought. Later that night, on 10 October 2023, at around 3:00 A.M., the defendant and Shimon Palit left the yeshiva in the direction of the Western Wall and the Sheikh Jarrah neighborhood, carrying a backpack with Molotov cocktails on their backs. At a certain point, they parted, Shimon returned to the yeshiva and the defendant continued walking in the direction of the Sheikh Jarrah neighborhood. The defendant arrived at Shimon Hatzadik Street, took the Molotov cocktails out of his bag, set them on fire and threw them at three residences on the street, causing a fire in the yard of the first house, as well as igniting the other Molotov cocktails. The defendant returned from there to the yeshiva, where he met Shimon.
