Attack on the guard
- The fifth charge accuses the defendant of assaulting a prison guard during his arrest in a waiting cell at the Jerusalem detention center. Guards Fares Fares and Ibrao Manjouri testified about the attack. Prison guard Fares testified that after the defendant was arrested, he was in a waiting cell in the detention center in the Russian Compound in Jerusalem (the complex). The defendant began to swear, spit and knock on the doors, and in response, the guards put him in an isolated cell and took off the handcuffs on the defendant. The defendant then attacked the guard Fares and hit him in the chest (p. 35 of the transcript of the hearing of February 2, 2025, lines 28-30, 34). Prison guard Fares described the act of assault in the following words: "... I took off his handcuffs, nice, and as soon as I took off his handcuffs he banged his head on me as if he had hit me in the chest" (p. 36 of the transcript of the hearing of February 2, 2025, lines 28-30, 34). Prison guard Fares stated that as a result of the attack, he suffered redness in his chest (p. 37 of the transcript of the hearing of 2 February 2025, line 15).
The guard Fares claimed that in response to the attack, the defendant was overpowered by the guard Fares and the guard Manjuri, dropped the defendant to the ground, handcuffed him and called the shift commander for further treatment. According to him, during the takeover of the defendant, the defendant used force, and as a result, the guards Fares and Manjuri knocked him to the ground, as follows: "We overpowered him to achieve the goal, now he used force, when I came to control him, Abreu wanted to handcuff him, he used force, we knocked him down to the ground, I handcuffed him, I fell with him, so I got hit from the floor in my hand and put an arm and leg handcuff on him, as if we had handcuffed him, and we called the commander of shift 33 as if for further treatment, and that's it.(p. 37 of the minutes of the hearing of February 2, 2025, lines 2-5). Prison guard Fares also testified that during the attempt to take control of the defendant, the defendant resisted and therefore reasonable force was used (p. 42 of the transcript of the hearing of February 2, 2025, line 3). Prison guard Fares also testified that after the assault, Fares went to the medic at the detention center and the medic documented the damage to the photos he had taken (p. 39 of the minutes of the hearing of February 2, 2025, line 17).
