Testimony of the witness Shimon Cohen to the police
- The defendant's involvement in the incident that took place in Sheikh Jarrah was testified by the witness Shimon Cohen (hereinafter: "Shimon"), who was also suspected of also participating in the preparation for the incident in Sheikh Jarrah and accompanied the defendant on his way to carry out the acts.
In his first interrogation with the police on 8 November 2023, Shimon maintained his right to remain silent, except for the statement that at the time of the incident he had gone with the defendant to the Western Wall (P/66, line 37). In his second interrogation with the police on 13 November 2023, in his interrogation on 14 November 2023 (Exhibit 68, Exhibit 68A), and in his interrogation on 15 November 2023 (Exhibit 69, Exhibit 69A), Shimon gave a detailed version, in which he linked the defendant to the act of throwing Molotov cocktails in Sheikh Jarrah.
- Shimon stated that he knew the defendant from their joint studies in the yeshiva (P/67A, p. 45, lines 49-50). He described that on October 9, 2023, he received two phone calls from the defendant (P/67A, p. 28, lines 711, 713; p. 29, line 746). In the second conversation, which took place in the evening, the defendant suggested that Shimon go with him to Rabbi Berland to pray, and Shimon answered in the affirmative (P/67A, p. 30, lines 758-759).
The two went to prayer and on the way back to the yeshiva the defendant told Shimon that he needed fuel, and they stopped at the Paz gas station (P/67A, p. 30, lines 758, 767; p. 31, lines 771, 777). The defendant handed Shimon a ILS 50 bill and Shimon went to fill up on gasoline. Shimon turned to the man who was at the station, told him that he was stuck with the motorcycle and needed fuel, and that man filled him with gasoline in the bottle, without taking any money in return (P/67A, p. 31, line 793; p. 32, lines 804, 811, 813, 823-824; P/68A, lines 314, 320, 324). All the while, the defendant was also at the gas station (P/68A, p. 10, lines 250, 252; p. 12, lines 290, 305-306). Shimon further described that after filling up the fuel, he went with the defendant to buy beers, for which the defendant paid (P/67A, p. 33, lines 833, 841; P/68A, p. 14, line 340; p. 20, line 518).
