When the two returned to the meeting they reached the defendant's room, the defendant opened beer bottles, Shimon drank beer from one of the bottles and left the room (P/67A, p.  34, lines 865, 871, 873).  At that time, the defendant began to "deal with her" (P/68A, p.  15, line 366).

Later, the defendant called him again and asked him to come to his room (P/67A, p.  35, lines 893-895; P/68A, p.  15, lines 368-372).  Shimon asked the defendant where the bottles were and where the gasoline was, and the defendant replied, "He prepared bottles" (P/67A, p.  36, line 908).  Afterwards, at 3 a.m., Shimon took a hoodie on the defendant's instructions, the defendant came with the "bag", and the two left in the direction of the Western Wall (P/67A, p.  37, lines 930, 938, 942; P/68A, p.  15, line 380; P/79A, p.  24, line 611).

  1. Throughout his interrogations with the police, Shimon described that he was aware of the defendant's plan to throw Molotov cocktails, and in his words: "I knew they were going to throw" (P/67A, p. 37, line 953), and also: "We will go burn down a house something like that, he wanted cars" (P/67A, p.  38, line 961).  Shimon also stated that the defendant had explicitly told him that he "wanted to do it" (P/68A, p.  12, lines 299-300).  Shimon emphasized that he did not believe the defendant when he expressed his desire to carry out the act, and in his words (in response to the question: "Did you know but you didn't believe it?"): "I knew, but I didn't believe that he would do it...  Because he is not such a person (P/69A, p.  15, line 395).  And (in response to the question: "Why does he need the gasoline?"): "I think it's going to hurt.  But I didn't believe he would do it.  I thought he was just laughing at me" (P/69A, p.  23, lines 587-588).  He clarified that he did not see the Molotov cocktails, but "imagined for himself" (P/67A, p.  42, line 1074).

Shimon further described that he tried to persuade the defendant to abandon his plan but without success, as follows: "Get off of it, leave you...  Come and throw it in the garbage and here and there", but the defendant did not listen to him (P/67A, p.  36, lines 908, 918-919; p.  37, lines 926, 928, 948-949 and also at p.  45, line 1137; P/68A, p.  12, lines 301-302).  He claimed that he did not believe that the defendant would actually carry out what he had planned, and in his words: "But I did not believe that he would burn ...  That's it..." (P/67A, p.  45, line 1144).  In his last interrogation on November 15, 2023, Shimon emphasized that he tried to arrest the defendant but went with him until he realized that the defendant did indeed intend to carry out the act, and in his words: "...  I told him two hundred times there, don't go, don't go, don't go, don't go, don't go, don't go, and this, it's as if every time the coward told me about it.  Until...  There, really, I didn't believe he would do it.  And I went and flowed with him until I suddenly realized that he was talking seriously (P/69A, p.  26, lines 678-680).

  1. Shimon stated that he walked with the defendant to Zawahil Square, and from there the defendant "cut," as he put it (P/67A, p. 10, line 232, p.  20, line 495).  Afterwards, Shimon returned to the yeshiva and went to sleep, and the defendant continued on his way.  Shimon claimed that he did not know where the defendant had gone from there (P/67A, p.  20, lines 497, 501-502).  Shimon described that later that night he saw the defendant again after his return (P/67A, p.  41, lines 1048, 1050; P/68A, p.  16, line 406).  According to him, he asked the defendant where he was, but the defendant did not speak to him and became angry with him (P/67A, p.  42, lines 1056, 1058; P/68A, p.  23, line 588).

Shimon further described that when he began to walk with the defendant towards the Western Wall, the defendant brought with him a backpack, which the defendant and Shimon carried alternately (P/67A, p.  19, lines 462, 466-467; p.  20, line 514; P/68A, 530).  Shimon described the backpack as a "black-gray bag" (P/67A, p.  37, line 944).  Shimon testified that he did not feel the glass bottles in the bag (P/67A, p.  22, line 548).  He also claimed that he had not seen Molotov cocktails at any point.  However, he confirmed that he imagined that there were Molotov cocktails in the file (P/67A, p.  42, line 1066; p.  43, line 1074).  Shimon claimed that he was not aware of any other cases in which the defendant sought to carry out attacks or throw Molotov cocktails (P/67A, p.  46, line 1177).
