In his cross-examination in court, the witness clarified that as part of the examination of the cab, a sample was not taken from the seat itself, because from there, based on accumulated experience, too many DNA mixtures are obtained.  Thus, the sample taken is from the door handle, the switches in the door, and the seat belt.  The witness was asked what the probability was that a long-term stay in the car in the hot August would not leave behind DNA findings, and he replied that probabilities were not his domain, but that he would expect to find the DNA of everyone who sat in the car.  He further testified that since he did not document in his reports that he had identified signs of cleanup attempts in order to obscure traces and conceal findings, he apparently did not encounter this in this case [transcript of June 4, 2024, at pp.  240-242].

From the biological opinion submitted [P/135] it can be concluded that the expert was able to produce a genetic profile for all the samples taken from the Mitsubishi, with the exception of the samples taken from the identification plates and the fuel tank [In the transfer of the hearing place, it was mistakenly recorded that these were samples collected from the Toyota, but this is an error that originated from the incorrect marking of the Hummer control, and the parties agree that these are in fact samples taken from the Mitsubishi - Protocol of June 4, 2024 at pp.  236-237, [241].  Eight genetic profiles were therefore extracted from the other eight samples, which were compared by the expert with the genetic profiles of the defendant, Abd al-Hadi and Samer, which were transferred to her from the DNA database.  It is not clear why a comparison was not made with other potential suspects, such as Udai, and the expert was not asked to testify and explain this.  In any event, according to the findings of the opinion, matches were found with respect to only two samples, while in the rest of the samples taken from the vehicle, partial and dismantled mixtures of a number of individuals were found, so that the mixture is not suitable for interpretation.
