The result is that today there is no longer any dispute that on the day of the murder, in the weeks preceding it, and in fact until 28 August 2025 at night, subscriber 685 was installed on the defendant's Samsung A32 phone, and that until 25 August 2025 in the evening, it was even used by the defendant.  The defendant's current [and suppressed] claim in his testimony in court is that on the evening before the day of the murder, he handed over this device to another, his cousin Samer, and received the phone back from him only on Sunday, 28 August 2022, at night, so that on the day of the murder he did not have the subscriber.  Therefore, the factual dispute with respect to the use of subscriber 685 was limited to the question of who held the subscription on the day of the murder and the two days thereafter, and there is no longer any dispute as to the fact that prior to the day of the murder the subscriber was in the possession of the defendant on one of the cell phones he used.

The narrowing of the dispute does not negate the significance of the fact that throughout the entire police investigation, the defendant gave a false version of the 685 subscription, repeatedly claiming that the subscriber was not known to him and that he had no connection to this subscription.  He gave his latest version in which he admits that this was a subscription that was used prior to the murder, for the first time in his testimony, at the end of the prosecution's case, and there is no escaping the conclusion that he did so only after the accuser proved with strong indisputable evidence that this subscription was indeed used by him on the relevant dates.  Thus, for example, when examining the photo folder on the phone, a screenshot of the defendant's face was found, as he took a picture of himself during a conversation on August 24, 2022 at 4:32 P.M., just two days before the day of the murder [P/99 - Assistance Insights Report 1153 - section 10B].  Voice messages dated 2 August 2022 and 24 August 2022 were also found in the unloading of the phone, which were identified by the investigators as matching the defendant's voice [P/99 - Exhibit 12A + E, P/105 - Voice Identification Memorandum].  In addition, correspondence in which the defendant identified himself by name, for example in a conversation with (omitted) dated July 18, 2022 [P/99 - para.  7, P/111 - the full correspondence] and in a conversation with another subscriber on July 31, 2022 [P/99 - para.  12C].  In addition, during a correspondence between Subscriber 685 and Sami Musrati, the defendant's cousin, Sami contacted him on August 2, 2022 under the name "Ayman", and later as "Abu al-Musrati" [P/102 - Assistance Insights Report 1275 - in section 5D and in the appendix marked S.A.  4, P/99 - in section 12e].  They also saw, in the following chapters, the connection between the defendant and his friend Wasfi, through the 685 subscription, and the correspondence between him and (omitted) in the same subscription.
