In his testimony in court, the defendant also confirmed that his three phones were code-locked and explained that he did not agree to hand over the codes to the police, because he did not want to cooperate with the investigation, and not because the phones contained private personal information [transcript of September 11, 2024, at pp.  513-514].  He further claimed that despite what he said in his fifth interrogation, in practice it was a uniform password for all three telephones [ibid., at p.  516].  It should be said at this point that despite the claim that other family members were aware of the code or codes, a claim that the defendant repeated in his testimony in court, no witness was brought on behalf of the defense who testified that he was aware of the codes, and the family members who did testify on behalf of the defense denied familiarity with those codes.  In addition, in light of the defendant's own statements, both in his statements to the police and in his testimony in court, it is not clear how the defense argued in paragraph 85 of their summaries that the existence of a code or password to enter the A32 was not proven.

In any event, during the course of the investigation, the investigators were able to uncover the code used to unlock the A32 device, on which subscriber 685 had been installed until the evening of August 28, 2022.

If that were not enough, then as I will present shortly, there is additional evidence that supports the conclusion that the person who held the 685 subscription, not only in the weeks before the murder, but also on the day of the murder itself, was the defendant, himself and no one else.

Fingerprint in the WhatsApp app and correspondence with WhatsApp

Wasefi Alsheikh (hereinafter: "Wasefi"), a 54-year-old resident of Jaffa, is a childhood friend of the defendant, his father and brother, who lived next door to them for many years and maintained friendly relations with them.  In his testimony in court, Waspi described the friendly relationship with the defendant and said that when the defendant would arrive in Jaffa, he would send a message, and the two would arrange to eat together in a restaurant, and maintain a kind of ongoing "family relationship" [transcript of May 15, 2024, at p.  185].  As can be seen from his testimony, as well as from his statement to the police P/146B, which was submitted with consent, and from the appendices attached to it from his phone, subscriber 063-2411-054, there were 4 numbers associated with the defendant on his phone.  Subscription 401 was reserved under the nickname "Iman Friend", Subscriber 337 was called "Iman Musrati", another subscription, which is not relevant to us, was called "Pax Iman", while subscriber 685 was reserved under the name "Iman 4".  Wasfi explained that most of the time he would talk to the defendant on the 401 subscription, and as for the 685 "Iman 4" subscription, it was a new line that the defendant had recently opened.
