It should be noted here that the documents seized from the Mazda were presented to Muhammad Abu Khalifa, the owner of the aforementioned business and the registered owner of the Mazda, when he was interrogated by the police on September 1, 2022, and he clarified that with the exception of the aforementioned delivery notes that were issued in his name, all the other documents were not his [P/146D, lines 66-69].  This implies that Abu Khalifa believed that the delivery notes belonged to him, but a thorough examination of the details on the certificate and the aforementioned appendix show that this is the delivery note of the defendant's telephone, which was seized from him on August 29, 2022, with a 401 subscription on it that he regularly uses [and I will mention the correspondence of July 18, 2022, with (omitted) in relation to the purchase of the new devices directly by the defendant, Following the seizure of his previous phones by the police - H.T.].  Therefore, even if the purchase was registered in the name of Abu Khalifa's business, these are documents that are directly related to the defendant and the telephone used by him, and hence all the documents seized from Mazda, which can be linked to any person, are closely related to the defendant.

Indeed, when the defendant was presented with photocopies of the documents during his interrogations with the police, the defendant explicitly confirmed that all the documents belonged to him [P/152 at p.  8], as well as in his testimony in court, in which he sought to disqualify only those documents that were issued in Abu Khalifa's name [transcript of September 11, 2024, pp.  483-484, 585-586], but as was explained, these documents are also closely related to the defendant and it is reasonable to assume that they will be found in his possession.  Against this background, the argument of the learned defense counsel that some of the documents seized in the Mazda door belong to Abu Khalifa, from which they seek to conclude that it is possible that the paper clipping also belongs to him.  As noted, all of the documents seized in Mazda are closely related to the defendant, and the same is the case with those delivery notes of his phone, even if Abu Khalifa's business is listed as the registered owner.
