In his actions, the defendant fraudulently received ILS 80,000 under aggravated circumstances.
The Facts of the Eleventh Indictment
- On a date unknown to the accuser, around August 2018, Wahbi Hilmi (hereinafter: "Hilmi") approached Majda, as part of her real estate brokerage practice, in order to purchase 500 square meters of land for construction, within the jurisdiction of the Daliyat al-Carmel Local Council.
Around August 2018, the defendant and Majda agreed that they would act to fraudulently sell parts of Dan Cohen's land (from the tenth indictment) to Hilmi, without Cohen's approval and knowledge, in order to receive the proceeds for the sale (hereinafter: the "Summary"). Later, in accordance with the agreement and in order to promote it, Majda offered Hilmi to purchase 500 square meters of land (hereinafter: "the lot"), and Hilmi agreed.
In accordance with the agreement and in order to promote it, Majda presented Hilmi with a false representation that the plot he wishes to purchase is located in Block 17135, Plot 48, sub-plot 23, and is owned by Tawfik Hanani, Majda's nephew (hereinafter: "Hanani" and "Misrepresentation", respectively). Majda told Hilmi that the asking price for the lot was ILS 182,000 in cash. Hilmi believed the misrepresentation.
On 10 August 2018, the defendant, Majda, Hilmi and Hilmi's father met at Majda's home. On this occasion, Majida introduced the defendant to Hilmi, and noted that the defendant, as part of his practice as a lawyer, represented the parties in the sale of the lot. The defendant and Majda stated to Hilmi that the defendant's fees were ILS 3,000.
In accordance with the summary and in order to promote it, the defendant presented Hilmi with a false representation that the plot was owned by Hanani and also presented him with a document entitled "Sale Agreement", which he brought with him ahead of time, in which it was written that Hanani undertook to sell the lot to Hilmi for a payment of ILS 182,000 and that Hilmi signed the document (hereinafter: the "Sale Agreement").
